Highway tort liability cases center on the responsibility of the highway
agency to operate its streets or roadways in a reasonably safe manner.
Highway accidents may occur due to the road, the roadside, design or
maintenance issues. The highway us examined to determine if highway
factors were dangerous in a manner that was a cause of the accident
or its severity. Our investigation of highway factors is frequently
supplemented by accident reconstruction to determine how the accident
occurred, human factor analysis of operator actions, and vehicle inspection
for mechanical failure that may have been a cause of the accident.
